State v. Federal Sovereignty
In my last email I mentioned State sovereignty. Federalist #32 [paragraph 2] defines which responsibilities/powers belong to the federal government alone.
An entire consolidation of the States into one national sovereignty would imply an entire subordination of the parts; State powers would be completely dependent on the federal government. But the Constitution is only a partial union or consolidation. The States retain all the rights of sovereignty they had before except those that are not exclusively delegated to the United States by the Constitution. State sovereignty is transferred to the Union in three cases:
(1) where the Constitution expressly grants exclusive authority to the Union;
(2) where it grants a specific authority to the Union and prohibits the States from exercising the same authority;
(3) and where it grants an authority to the Union, to which similar authority in the States would be absolutely and totally contradictory and repugnant.
This last case is different from concurrent jurisdiction. When there is a concurrent jurisdiction, national and State policies may overlap occasionally, but there won't be any direct contradiction of constitutional authority.
The three cases of exclusive federal jurisdiction may be exemplified by the following:
(1) The next-to-the-last clause of article one, section eight, says Congress will exercise "exclusive legislation" over the capital district. This answers the first case.
(2) The first clause of article one, section eight empowers Congress "to lay and collect taxes, duties, imposts, and excises;" and the second clause of article one, section ten declares that, "no State shall, without the consent of Congress, lay any imposts or duties on imports or exports, except for the purpose of executing its inspection laws." Therefore, the Union would have exclusive power to lay duties on imports and exports, with the specific exception mentioned. But this power is limited to duties on imports. Another clause declares that no tax or duty shall be laid on articles exported from any State. This answers the second case.
(3) The third is the clause that declares Congress will "establish a uniform rule of naturalization throughout the United States." This must be an exclusive power because if each State had power to prescribe a distinct rule, there could not be a uniform rule.*

The military by design and by law is subject to their civilian leadership. Starting with President Clinton, Progs/Lib/Dems (civilian bureaucrats and military officers) were appointed to low positions in DOD. They are now floating to the surface on both the civilian and the military side. I think Robert Gates is one and General McChrystal are the result. Neither Gates as SecDef nor Gen McChrystal in Afghanistan have impressed me. The purpose of the Armed Forces is to kill people and destory things. There are too many restrictions in the Rules of Engagement (ROE) for our guys in Afghanistan. But, what do I know? I am only a retired Colonel!

Frank Luntz, author of the 2009 book, "What Americans Really Want ... Really: The Truth About Our Hopes, Dreams and Fears", has done a lot of work for the Fox News Network as a frequent commentator and analyst and helping Glenn Beck and Sean Hannity run discussion groups on camera.
I enjoy, like, and appreciate the work that Glenn and Sean do informing listeners about the state of the Union and liberty. I also realize that Frank has to make a living doing what he does best: dealing with communication strategies and public opinion and running focus groups.
But, there is a fly in the ointment. Frank Luntz does not sift out the enemies of liberty and all that Fox News Network apparently stands for from his list of clients. He apparently uses his extensive talents and abilities for people on both sides of the liberty debate.
According to the May 2010 issue of NRA's America's 1st Freedom, page 16, Frank Luntz used his considerable abilities to to conduct a Bogus NRA Member "Poll". "In [NRA's] February 2010 issue ("First Things First," p. 12), we noted that a poll paid for by anti-gun Mayor Michael Bloomberg, claiming to show that NRA members support gun control, was conducted by a pollster who's been reprimanded and censured by two professional polling organizations, and who (of course) doesn't have access to the NRA's confidential member list.
"Since then, gun control supporters have cited the poll in numerous newspaper editorials, opinion columns and letters to the editor, all attacking the NRA's opposition to gun control.
"Bloomberg's pollster, Frank Luntz, has admitted the manner in which he gets polls to turn out the way his employers want. In a "Penn and Teller" interview posted on YouTube, Luntz says, "The key in survey research is to ask questions that people care about the answers [sic], and to ask the question in a way that you get the right answer.
"He added, '[W]ith just a single change of wording, you'll get a very different reaction in terms of how that think and how they feel.
"Thanks, Frank, for making it easier for us to write letters to newspapers pointing out why no one should take your 'poll of NRA members' seriously."

I am not fo sure. 80,000 troops is not a brigade. A Brigade is usually about 3-4,000 troops. Three Brigades make a Division of about 15-20,000 with support troops. This would be a large Corps which usually has 2 or 3 Divisions. 80,000 is a lot. We have only tops 68,000 in Afghanistan!

It doesn't really matter, one way or the other, governments WILL get more money. Cuts due to the economy will cost you more; cuts due to desire to be more "green" will cost you more; increases due to the economy will cost you more; increases due to your wastefulness with cost you more.
